On May 15, President Bolsonaro issued MP 966, which delimited the responsibility of the public agents in actions and omissions in the combat to the Covid-19 pandemic.

For the context of facing the pandemic, the Provisional Measure reproduces series of provisions of the Law of Introduction to the Norms of the Brazilian Law, but the definition of big error remained open.

The Supreme Federal Court confirmed the understanding that a big error is activity of the public agent, which is not based on scientific criteria and guidelines from national and globally recognized bodies, such as WHO.

As MP 966 did not restrict the administrative area of action, the decision of STF shall be followed by the States and the Municipalities, in order to safeguard the responsibility of the public agents in the combat to the covid-19 pandemic.
